Article 2 - General
 

2.1 These general terms and conditions apply to all offers of AHPPKIT.com and any of its affiliates. The conditions are accessible to everyone and included on the internet site
2.2 By placing an order you indicate that you agree with the delivery and payment conditions.  AHPPKIT.com reserves the right to change its pickup, delivery and / or payment conditions after the expiry of the term.
2.3 Unless otherwise agreed in writing, the general or specific conditions or stipulations of third parties are not recognized by AHPPKIT.com.
2.4 AHPPKIT.com guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.

 

 Article 3 - Delivery
 

3.1 Delivery takes place while stocks last.
3.2 Under the rules of the Distance Selling Act, AHPPKIT.com will execute orders within 14 working days. If this is not possible (because the ordered item is out of stock or no longer available), there is a delay for other reasons or an order cannot be executed, or only partially filled, the customer will receive a message from AHPPKIT.com to the customers email address which states the product is out of stock or unavailable and will receive a total refund by way of a credit to the method of payment originally made by the customer. 

3.3 The place of delivery is the address that the customer has made known to AHPPKIT.com.
3.4 The delivery obligation of AHPPKIT.com will be fulfilled once a tracking number has been provided to customer.  Re-fulfilling orders or refunds will only be provided with a proof that the product was never delivered, an undelivered receipt from the carrier must be provided.

3.5 All terms stated on the website are indicative. No rights can therefore be derived from the aforementioned periods.

 

 Article 4 - Prices
 

4.1 Prices will not be increased within the term of the offer, unless legal measures make this necessary or the manufacturer implements interim price increases.
4.2 All prices on the site are subject to printing and typing errors. No liability is accepted for the consequences of printing and typesetting errors.
4.3 All prices on the site are in U.S dollars and do not include sales tax or delivery fees which will be calculated at check out.

 

Article 5 – Return of damaged items
 

5.1 The customer has the right to a replacement of a defective part if received defective part with a purchase. The customer must notify AHPPKIT.com at support@ahppkit.com of such defect within 30 days of notification that their purchase has been assigned for delivery by a carrier (carrier tracking receipt). AHPPKIT.com has the option to require defective part to be returned. If return of defective parts is requested, return shipping will be paid by AHPPKIT.com. If return has been requested, and the customer has not returned the defected delivered part to AHPPKIT.com before this period has expired, the purchase is a fact. The postmark on return must be within the stated 30 day period.  The part(s) must be returned in the original packaging (including accessories and accompanying documentation TAGS) and in new condition. If the parts have been used, encumbered or damaged in any way by the customer, the right to dissolution within the meaning of this paragraph will lapse. With due observance of the provisions of the previous sentence, AHPPKIT.com will ensure that the part will be replaced. The replacement item will be shipped at AHPPKIT.com expense.
 

Article 6 - Data management
 

6.1 If you place an order with AHPPKIT.com, your data will be included in the customer database. AHPPKIT.com adheres to the Data Protection Act and will not provide your information to third parties. 

6.2 AHPPKIT.com respects the privacy of the users of the internet site and maintains confidentiality of your personal information to the best of our ability. AHPPKIT.com or any of its affiliates cannot be held liable for data breeches beyond our control.
 

Article 7 - Warranty

 

7.1 AHPPKIT.com is for use in water systems only and guarantees only that upon correct installation, the system it delivers will meet the stated operability, pressure and temperature ratings as stated on the AHPPKIT.com website. Consumer is responsible for confirming their individual home water pressure and temperature operating conditions are within component design.  Any warranty claims of the AHPPKIT system components are to be settled with the individual component manufacturer except as stated under Article 5.
7.2  Any manufacturers warrantees are void if: A) the customer has repaired and / or processed the delivered goods himself or has them repaired and / or processed by third parties. B) the delivered goods have been exposed to abnormal conditions or are otherwise handled carelessly or have been treated contrary to the instructions of AHPPKIT.com and / or instructions on the packaging; C) the inadequacy is wholly or partly the result of regulations that the government has made or will make with regard to the nature or quality of the materials used.
 

Article 8 - Agreement
 

8.1 An agreement between AHPPKIT.com and a customer is concluded after an order assignment by AHPPKIT.com has been assessed for feasibility.
8.2 AHPPKIT.com reserves the right not to accept orders or assignments without stating reasons or to accept them only on the condition that the shipment is made after payment in advance.

 

Article 9 - Images and specifications
 

9.1 All images, photos, videos, logos, etc. on AHPPKIT.com are property of AHPPKIT.com and cannot be copied or reused without previous approval from AHPPKIT.com

9.2 All images; photos, drawings, etc.; Among other things, data regarding weights, dimensions, colors, images of labels, etc. on the website of AHPPKIT.com are only approximate, are indicative and cannot lead to compensation or dissolution of the agreement.
 

Article 10 - Force majeure
 

10.1 AHPPKIT.com or any of its affiliates are not liable if and insofar as its obligations cannot be fulfilled as a result of force majeure.
10.2 Force majeure means any strange cause, as well as any circumstance that should not reasonably be at its risk. Delays or non-performance by our suppliers, disruptions in the Internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in the supply, negligence of suppliers and / whether manufacturers of as well as auxiliary persons, illness of personnel, defects in auxiliary or transport equipment are expressly regarded as force majeure.
10.3 AHPPKIT.com reserves the right in case of force majeure to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement is amended in such a way that execution remains possible. . Under no circumstances is [merchant name] obliged to pay any fine or compensation.
10.4 If AHPPKIT.com has already partially fulfilled its obligations when the force majeure commences, or can only partially fulfill its obligations, it is entitled to invoice the already delivered or deliverable part separately and the customer is obliged to pay this invoice. as if it were a separate contract. However, this does not apply if the already delivered or deliverable part has no independent value.
 

Article 11 - Liability
 

11.1 AHPPKIT.com is a patent pending system for use in water systems only. AHPPKIT is sold as a “kit” comprising of various manufacturer components and is a consumer D.I.Y. (do it yourself) installed kit.  Each AHPPKIT system installation assumes the line or group of lines you are protecting in your home has a common supply source and that the hot and cold water lines are at the same pressure (i.e. Pressure of one or more lines protected by a single AHPPKIT system are not increased by a booster pump or regulated down).  Therefore AHPPKIT.com or any of its affiliates, component manufacturers, distributors or any of their affiliates, are never liable for damage caused by incorrect installation or misuse by the customer.

11.2 AHPPKIT.com or any of its affiliates are never liable for damage to property or other objects caused by individual manufacturer component failure.  

11.3 Read the instructions provided in the AHPPKIT and included with the individual components prior to installation and use.  Consult our website and instructions for individual AHPPKIT system component operating pressure and temperature limits.  Or consult the individual component manufacturer.
